Terms of sale and license

1. Purpose

These terms govern the sale, by Plume Studio, a French sole proprietorship, SIRET 131 096 893 00014 ("we"), of licenses to use the premium features of the Plume Visuals Power BI visuals (the "Visuals") through https://plumevisuals.com. Placing an order implies accepting them.

Our offers are intended for individuals as well as businesses, whatever the tier. Provisions specific to consumers are indicated.

2. Free version and premium features

Each Visual can be downloaded free of charge from the customer area of this site ("Downloads"). Publication on Microsoft AppSource is planned (Microsoft certification in progress); once published, the Visual will also be available there, or from your organization's store. The free version can be used with no time limit. Premium features, described on each Visual's page, can be tried freely: they then show a watermark. A valid license key removes the watermark.

3. Offers

Every license is a one-year license, acquired through a one-time payment, with no automatic renewal. It covers:

• one Visual: the key unlocks the premium features of that Visual only;
• or the catalog: the key unlocks the premium features of every Visual in the catalog, including those published later.

It is sold in three tiers, defined by the number of users. A user is anyone who creates, edits or views a report containing the Visual concerned, whatever the means of access (Power BI Desktop, the Power BI service, mobile apps, embedded reports, exports): designers and viewers both count. The number of users is the number of distinct people who, within the licensee organization, create, edit or view these reports during the license term.

• Personal: 1 to 10 users. Open to individuals, freelancers and organizations. The key is issued in the licensee's name (the person or the organization).
• Small business: 11 to 200 users. The key is issued in the organization's name.
• Enterprise: more than 200 users, with no limit. The key is issued in the organization's name.

The tier is declared by the buyer at checkout. If the number of users later exceeds the cap of the tier purchased, the current license remains valid until its end; the tier matching the new number of users is required for subsequent purchases and renewals. A license cannot be transferred to another organization.

Consultants and service providers: since the key is stored in the report, a report delivered to a client must be covered by a license in that client's name.

4. Prices and payment

Prices are in euros, for a one-year license. We are under the French VAT exemption scheme for small businesses: VAT not applicable, art. 293 B of the French tax code (CGI). The price shown is therefore the price you pay, whatever the tier and your country. If you buy for an organization, whatever the tier, you can enter its VAT number at checkout: it then appears on the invoice.

Payment is made online, in a single instalment, through Stripe. An invoice is issued for each purchase or renewal and remains available in your account. Nothing is ever charged without your action: a renewal is a new purchase that you freely decide to make.

We may change our prices at any time; current licenses are not affected. A renewal is charged at the price displayed when you renew.

5. Term

The license is granted for 12 months from payment. It includes updates we publish for the Visual(s) concerned during that period.

Grace period. The key is still accepted by the Visuals for 30 days after the license ends, to give you time to renew and replace the key in your reports.

Reminders and renewal. We email you 30 days and then 7 days before the license ends. Renewal is never automatic: you renew from your account, on the terms and at the price in force at that time. If you renew before the end, the new 12-month period starts when the current one ends; otherwise it starts on the day of payment. A renewal keeps the same licensee, tier and Visuals.

At the end. Without renewal, the license ends after the grace period: the Visuals and your reports keep working, but premium features show a watermark again. No feature is blocked and no data is lost. No cancellation is needed.

6. License key

After payment, the key is available in your account and sent by email. It carries its end date (end of the license + grace period), checked by the Visual without contacting our servers. Each renewal produces a new key, to paste in your reports instead of the previous one. The licensee's name, written into the key, may be shown in the Visual.

Changing the licensee's name (correction, new company name) generates a new key with the same end date; this is possible once every 30 days from your account.

7. Conditions of use

You agree not to: share the key outside the licensee (the person or organization in whose name it is issued); declare a tier that does not match your number of users; publish the key or reports containing it publicly (for example via "Publish to web") for the benefit of third parties; decompile, modify or circumvent the Visuals' licensing mechanism, except as permitted by law.

Any serious breach may lead to termination of the license without refund. If an order is refunded, the corresponding key must no longer be used.

8. Right of withdrawal and refunds

If you are a consumer, you normally have 14 days to withdraw. However, since the license key (including a renewal key) is digital content supplied immediately after payment, you expressly request its immediate supply by ticking the box provided at checkout and acknowledge that you thereby lose your right of withdrawal (French Consumer Code, article L221-28, 13°). This is confirmed to you by email with your key.

Refund policy. Whatever your tier, we fully refund an order on simple request to contact@plumevisuals.com within 30 days of payment if the license key does not work, or if a blocking defect in the Visual that was reported to us could not be fixed. An order paid twice by mistake is refunded unconditionally. Refunds are issued by Stripe to the original payment method, usually within 5 to 10 business days. The corresponding key is then deactivated and must no longer be used.

9. Warranties and liability

The Visuals are provided as is, in accordance with their description. We undertake to fix blocking defects reported to us within a reasonable time. We do not guarantee compatibility with future versions of Power BI changed by Microsoft, but we strive to maintain it.

Towards businesses, our liability is limited to direct damages and capped at the amount paid for the license concerned.

11. Governing law and disputes

These terms are governed by French law. In case of dispute, an amicable solution will be sought first (contact@plumevisuals.com).

Consumers: you may use the consumer mediator free of charge [mediator name and contact details].

Businesses: failing an amicable agreement, the courts with jurisdiction over the publisher's registered office have exclusive jurisdiction.
